INTRODUCTION WHAT IS KOPITAN KOPITAN stands for The Reproduction Rights Society of Tanzania. A reproduction rights organization (RRO) is a collecting society which licenses the reproduction of copyright protected materials such as books, journals, magazines and newspapers against payment of fees whenever it is impractical for authors and publishers to license and collect fees individually. It is a non-profit organization registered under the Companies Act (Act No 12 of 2002 of The Laws of Tanzania) as a company limited by guarantee. WHY AND WHEN WAS KOPITAN ESTABLISHED KOPITAN was launched on 10 October 2008 and registered with the registrar of companies on 1st day of June 2009. The organization was formed under the provisions of Sections 46 of the Tanzania Copyright and Neighboring Rights Act, Act No: 7 of 1999, as amended. The primary objective of establishing KOPITAN was to ensure the provision of collective management services to the rights holders in literary, artistic and dramatic works. This, in essence, means that KOPITAN acts on behalf of copyright owners in the afore-mentioned copyright works and the users of those works, especially when the users wish to exploit the work in question for any purpose that requires the copyright owner's prior consent. The establishment of KOPITAN and other similar bodies is an obligation of the Government of the Republic of Tanzania to comply with various international treaties and conventions that Tanzania as a country had committed herself to. One such international Convention is the Berne Convention of 1886, as amended, for the Protection of Literary and Artistic Works.
OBJECTIVES The objectives of KOPITAN among others are to: · Create awareness of reproduction rights among rights holders; · Create awareness of copyright among users- especially Universities, · Ministry of Education and General Public · License copyright users; · Collect fees for photocopy and rental of copyrighted works. · Distribute royalties to copyright owners. MISSION STATEMENT · Promote and advance the rights of copyright owners · Raise public awareness and understanding of Tanzania Copyright Law and the collective administration of copyright · Enforce the rights of copyright owners
VISION · A collecting society which writers can turn to with confidence that rights which are administered collectively will be protected and exploited to the full extent of the law and according to their wishes.
· We will actively encourage and participate in rights education programmes and will join with others to lobby nationally and internationally for authors’ rights.
· Our alliances will be with other creators’ rights organisations but we will also need to continue with, or create new, partnerships with other rightsholder organisations, with the scholarly and educational communities, with publishers, broadcasters, libraries, information and IT companies, with consumers and with government. |
